1 . GENERAL
1.1. We reserve the right to change these terms and conditions at any time. Any such changes will take effect when posted on the website (see date at the top), and it is your responsibility to read the terms and conditions on each occasion you use this website, and your continued use of the website shall signify your acceptance to be bound by the latest terms and conditions.
1.2. Certain website services will require registration, and subsequent access to those services will be subject to an approved login name and password (“Password Details”). Information that you provide on this website must be accurate and complete. All Passwords Details are accepted and may be withdrawn at our sole discretion and are exclusive to you and non-transferable and must be treated as strictly confidential at all times. 2 . Prices
2.1 Prices listed are subject to change daily.
2.2 Prices include VAT at current rates of 23% but exclude delivery charges.
3. Order Process
3.1 To fulfil your order, we require all necessary fields within the order form to be completed with the relevant information. By submitting your order and payment details, you are consenting to be bound by our terms and conditions contained in these Terms and Conditions and appearing anywhere on the site.
The ‘confirmation’ stage sets out the final details of your order. Following this, we will send you an order acknowledgement email detailing your ordered products. Please note that this email is not an order confirmation or acceptance from LUNA DECOR.
Acceptance of your order and the completion of the contract between you and us will take place on dispatch to you of the products ordered unless we have notified you that we do not accept your order or you have cancelled it (please refer to Returns and refunds).
3.2 Your purchase will be deemed to have occurred in Ireland. These Terms and Conditions shall be governed by and construed in accordance with Irish Law, and the parties agree to submit to the exclusive jurisdiction of the Irish courts.
We do not file details of your order for you to subsequently access direct on this website, and therefore, please print out these terms and conditions and the order acknowledgement for your own records. If you wish to obtain specific details of your previous orders please Contact us.
4 . Delivery
4.1. This website only delivers products to customers in the Republic of Ireland. Delivery charges and estimated timescales are specified in the DELIVERY & RETURN section when you place an order. We make every effort to deliver goods within the estimated timescales. However, delays are occasionally inevitable due to unforeseen factors. LUNA DECOR shall be under no liability for any delay or failure to deliver the products within estimated timescales.
4.2. Delivery charges will be applicable within the specified area. Suppose you request delivery to remote areas that are generally not delivered to you. In that case, you will be advised of any additional charges as soon as possible upon receipt of your Order Form.
4.3. Should a timed delivery be requested, we will endeavour to comply with the request but cannot be bound in any way to honour such a request.
4.4. For next-day delivery, we must receive your Order Form by 12:00 (12 noon) GMT. We will process orders received on Sundays or Public Holidays the next working day. We do not deliver on Saturdays, Sundays or public holidays.
4.5. Where incorrect personal and delivery details have been supplied, problems or delays in delivery may result, therefore please ensure that you have included the full address details of the intended recipient and your daytime telephone number or e-mail address so that we can notify you in the event that any delivery problems occur.
The risk of product loss and damage passes to you when the products are delivered or on the date of our first attempted delivery.
In case part of the order is missing, we require proof – we accept only proof of a photo taken immediately after opening.
5. Payment
5.1. We recommend you order online using our secure order form. If using a credit card from outside the Eurozone, the currency conversion will be done by the credit card company.
We take payment from your card when we receive your order once we have checked your card details and stock availability. Goods are subject to availability. If we cannot supply the goods, we will inform you of this as soon as possible. A full refund will be given when you have already paid for the goods.
5.2. To ensure that your credit, debit, or charge card is not being used without your consent, we will validate your name, address and other personal information supplied by you during the order process against appropriate third-party databases. By accepting these terms and conditions, you consent to such checks being made. In performing these checks, personal information provided by you may be disclosed to a registered Credit Reference Agency, which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the General Data Protection Regulation. Please read our Privacy policy for further information.
5.3. The price you pay is the price displayed on this website at the time we receive your order, apart from the following two exceptions:
a) For products reserved online for store pick up or any other reservation service, you pay the price in-store on the day of collection.
b) While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the goods you ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we cannot contact you, we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.
5.4. Title to any products you order on this website shall be passed to you on delivery of the products, provided that we have processed and received payment in full.
5.5. All prices are shown in € / euro and include VAT at the applicable current rates but exclude delivery charges.
6. RETURNS, CANCELLATIONS AND SUBSTITUTIONS
6.1. We offer a 28-day money-back guarantee. Please refer to DELIVERY & RETURN. Some products are excluded from the Guarantee and are clearly marked by a † next to the product name. In the unlikely event you receive faulty or damaged goods, please refer to our Returns and refunds section.
6.2. Sometimes, the product specifications from the manufacturer may change, so we will do our best to offer you a similar alternative. We may experience problems with the supply of certain products and may therefore supply a substitute of the same or better quality at the same price. If you are unhappy with the replacement or substitute, you can return it according to our 14-day money-back guarantee. Where applicable, you may cancel your order in accordance with your rights under the Distance Selling Regulations (see the Returns and refunds page for further details).
6.3. All sizes and measurements are approximate, but we try to ensure they are as accurate as possible.
7. Our Products
7.1 If we cannot provide your chosen item or a suitable substitution, we will advise you as soon as possible and refund your payment in full within 30 days.
8. MISCELLANEOUS PROVISIONS
8.1. The laws of Ireland shall govern the contract between us, and any dispute will be resolved exclusively in the courts of Ireland.
8.2. LUNADECOR shall be under no liability for any delay or failure to deliver products or otherwise perform any obligation as specified in these terms and conditions if the same is wholly or partly caused, whether directly or indirectly, by circumstances beyond its reasonable control.
8.3. To increase our customers’ value, we may provide links to other websites or resources for you to access at your sole discretion. You acknowledge and agree that, as you have chosen to enter the linked website, we are not responsible for the availability of such external sites or resources, do not review or endorse and are not responsible or liable, directly or indirectly, for (i) the privacy practices of such websites, (ii) the content of such websites, including (without limitation) any advertising, content, products, goods or other materials or services on or available from such websites or resources or (iii) the use to which others make of these websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such advertising, content, products, goods or other materials or services available on such external websites or resources.
If any portion of these terms and conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity or enforceability of the other sections of these terms and conditions shall not be affected.
8.4 These terms and conditions, including the documents or other sources referred to in these terms and conditions, supersede all prior representations, understandings and agreements between you and LunaDecor relating to the use of this website (including the order of products) and set forth the entire agreement and understanding between you and LunaDecor for your use of this website.
